<div class="ecn ec-sc ec-member-practice-area"><div class="content">Before joining Fourth Floor Chambers Konrad was, between 1989 and 2021, a partner in the Disputes Group of Herbert Smith Freehills. He is also admitted to legal practice in England and Wales as a solicitor advocate. Between 1998 and 2000 he worked for Lovell White Durrant in their international and cross border insolvency group.</p>
<p>Konrad specialises in major commercial disputes and dispute resolution involving corporate governance, directors’ duties, banking and financial instruments, breaches of contract, professional negligence, corporate insolvency and reconstruction, planning, valuation and industrial and employee disputes.</p>
<p>Konrad is an experienced trial and appellate advocate. He has appeared as lead counsel in cases in the High Court, Federal Court, Supreme Court and the State Administrative Tribunal. Those cases have involved contractual disputes, professional negligence, issues and disputes concerning liquidations, receiverships and administrations, breach of director&#8217;s duties, share buy backs, land valuation, planning, employment and industrial relations disputes. He has also been lead counsel in international arbitration and expert determination matters.</p>
<p>Konrad is regularly ranked in Australian Legal Guides including Best Lawyers, Doyle’s and Chambers.  In the Doyle’s Guide 2024, Konrad is listed as:</p>

<p>Steven has many years&#8217; experience in commercial litigation, having worked for 30 years as a commercial litigation lawyer at Herbert Smith Freehills prior to joining the Bar in 2015.</p>
<p>Since commencing as a barrister, Steven has acted in a wide range of matters including:</p>

<li>Construction, oil and gas and mining disputes and arbitrations</li>
<li>Misleading and deceptive conduct disputes</li>
<li>Corporation matters including directors duties and shareholder oppression claims</li>
<li>Estate administration, will and family provision claims</li>

<li>Liquor licensing matters (including regular appearances for one of Australia&#8217;s major retailers in various licensing applications and appeals, and representing defendants in prosecutions)</li>

<p>Steven completed mediator accreditation training in 2015 and since then has mediated more than 50 disputes (nearly all of which settled) and has published papers and presented a number of seminars in this area.</p>
<p>Steven also has extensive competition law experience including in relation to price fixing, market power and restraint of trade cases, negotiations with the ACCC, preparation of notifications for joint ventures and marketing arrangements, and advice in relation to advertising and misleading and deceptive conduct issues.</p>
<p>Steven was a member of the Competition Committee of the Law Council of Australia for a number of years.</p>

<p>Nicholas is a commercial barrister who practises in private and public law dispute resolution.</p>
<p>Before being called to the Bar, Nicholas worked as the High Court of Australia’s Legal Research Officer. He then practised as a solicitor in Melbourne and worked most recently as special counsel at a boutique firm in Perth that specialises in commercial dispute resolution, mining, energy, and resources. He has had the carriage of litigation in the High Court of Australia, Federal Court of Australia, Supreme Court of Western Australia, Warden’s Court, and lower courts and tribunals.</p>
<p>Nicholas has published numerous books and articles on private and commercial law and has worked at University College London, the University of New South Wales, and the University of Western Australia.  Nicholas publishes and has taught in the areas of contract law, commercial equity, trusts, remedies, unjust enrichment, jurisprudence, legal history, and commercial law. He is the general editor of the <em>Journal of Contract Law</em> and an Adjunct Associate Professor in Private Law at the University of Western Australia.</p>
<p>Nicholas holds a Doctor in Philosophy (Law) from University College London which he completed as the inaugural Peter Birks Memorial Scholar, a Master of Laws (Dist) from University College London (where he was ranked first in his year and studied on the Sir John Salmond Scholarship) and a Bachelor of Laws (Hons I) from the University of Western Australia. A list of his academic prizes and publications can be found in his curriculum vitae.</p>
